MOTION TO AUTHORIZE the Chief Information Officer to approve and execute any related documents or click-thru agreements with ARIN as may be required to maintain the services provided under the Registration Services Agreement during the term of the agreement, subject to review by the County Attorney’s Office for legal sufficiency and provided there is no additional cost to the County.

Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.53, the Board is required to approve all contracts for supplies or services of more than five years.
What Action Accomplishes
This Agreement replaces the current Services Agreement with ARIN and secures the County’s legacy Internet Protocol (IP) addresses through required registration thereby providing continuity of online services and dissemination of information to all County stakeholders, including residents, and County staff, via County’s webpages.

Summary Explanation/Background
THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE ENTERPRISE TECHNOLOGY SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This item supports the Board’s Value, “Consistently delivering responsive, efficient, quality services to the public and internal customers.”
American Registry for Internet Numbers, Ltd. (ARIN) is the non-profit governing body responsible for administering internet numbers for North America. Through the Registration Services Agreement (Exhibit 1), the Internet Protocol (IP) addresses held by ARIN are secured and preserved for the County’s sole use. The County uses its registered IP addresses to provide information and services to County residents as well as for County staff in the performance of assigned duties.
The County has been under contract with ARIN for the County’s registered IP addresses since 2008. In 2008, the Director of Purchasing approved a Services Agreement between the County and ARIN to provide registration services for a term of one year, with automatic annual renewals. The County received annual invoices for the automatic renewal of the registration fee under that agreement, which were paid via credit card beginning in 2009 until 2021, exceeding the duration under Section 21.53 of the Procurement Code, which requires Board approval for any contract duration in excess of five years; this action shall provide proper conformance with the Procurement Code. The proposed Registration Services Agreement will replace the prior Services Agreement. The fees under the Registration Services Agreement are $150/year.
Request for Information (RFI) No. TEC2124538F1, issued on April 19, 2022 to determine if other vendors could provide the requested services, yielded zero response when closed on April 25, 2022. As a mandatory need to maintain this service for the purpose of preserving ownership over IP addresses in use by the County, a sole source designation was approved by the Purchasing Division (Exhibit 2).
The proposed Agreement includes certain nonstandard terms, which the vendor declined to modify and which the Enterprise Technology Services Division recommends be approved as consistent with industry standards, including:
1. The Agreement will automatically renew each year unless terminated. The County can terminate voluntarily at any time.
2. ARIN, at its sole discretion, may increase the cost per IP registration, provided that ARIN must set its fees in an open and transparent manner through the ARIN community consultation process.
3. In the event of a dispute that is not resolved by negotiation, the dispute will be resolved by binding arbitration.
4. ARIN’s liability is limited to the amount paid in the six months preceding the claim or $100, whichever is greater.
5. The Agreement is governed by Virginia law.
