Summary Explanation/Background

On September 21, 2021, the Board enacted an Ordinance creating Section 20-164.2 of the Broward County Code of Ordinances prohibiting private parking facilities from issuing private parking tickets to motor vehicles. During the 2022 legislative session, the Legislature enacted Committee Substitute/Senate Bill 1380 ("CS/SB 1380"), which prohibits counties and municipalities from enacting ordinances restricting private property owners or operators from establishing their own rules and rates to govern private parking on their property. CS/SB 1380 declares all prohibited local ordinances null and void.

 

At the time of printing this agenda, CS/SB 1380 has yet to be presented to the Governor. If the Governor has not approved the bill before the public hearing, the Office of the County Attorney will again seek to continue the public hearing.
