Summary Explanation/Background

On April 26, 2022, the Board directed the Office of the County Attorney to draft a proposed Ordinance to amend Section 26-125(d) of the Broward County Code of Ordinances.  Section 26-125(d) generally requires that a vendor seeking a contract in the amount of $100,000 or more with Broward County certify that it has implemented or will implement policies, practices, and procedures that preclude inquiry into an applicant's criminal history until the applicant is selected as a finalist and interviewed for the applicable employment position.

 

The proposed Ordinance amends the definitions of "applicant," "finalist," and "initial application for employment" to clarify that the definitions apply to vendors.  Further, the proposed Ordinance provides that the precluded inquiry into an applicant's criminal history by a vendor relates only to employment positions within the United States that will foreseeably perform work under, if awarded, a contract with Broward County.
