Board of County Commissioners' action is required to release restrictive covenants pursuant to Broward County Administrative Code, Section 6.3.

 

What Action Accomplishes

Releases restrictive covenants of a city-owned parcel to complete an exchange and transfer restrictions to another parcel, Folio Number 4743-3106-0090.

Summary Explanation/Background

Folio Number 4743-3100-0140 was transferred to the City of Deerfield Beach for the construction of a single-family home on May 8, 2012. The parcel was transferred to the City and contained a certain deed restriction stating that if construction of the single-family residence was not completed, then the parcel would revert back to the County.

 

The City has determined that the parcel is unbuildable and cannot accommodate a single-family residence meeting affordable housing requirements. The County and the City came into an agreement to exchange Folio Number 4743-3100-0140 with Folio Number 4743-3106-0090, with an understanding that the restrictions would transfer to the new parcel that the City has deemed buildable. These new restrictions were recorded on November 16, 2021.

 

All documents have been reviewed and approved as to form by the Office of the County Attorney.
