Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “approaching human services collaboratively and compassionately with special emphasis on the most vulnerable,” and the goal to “effectively advocate for and acquire municipal, state and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care.” The reallocations will ensure the most effective and efficient use of currently budgeted resources and will allow service providers to increase the number of clients. Commission authorization is requested to provide the HSD Director or Deputy Director discretion to waive the penalty reduction found in the Performance Article of the Agreement for Fiscal Year 2021-2022, to ease the financial impact on service providers due to COVID-19.

 

On September 9, 2021 (Item No. 4), the Commission approved Resolution No. 2021-402, authorizing appropriation and disbursement of Fiscal Year 2021-2022 funds for agreements with nonprofit organizations and governmental entities to provide various services. Since then, contract utilization patterns and client demands have demonstrated a need for increased services in specified service areas resulting in the reallocation of underutilized funding. The Community Partnerships Division recommends reallocating funds from underutilized agreements in its Children’s Services Administration Section, Health Care Services Section, and Homeless Initiative Partnership Section to meet the current community needs (Exhibit 1). Commission approval is required because the requested increased funding amounts exceed the threshold authorized by the existing agreements. Retroactive approval is requested to allow service providers to invoice Broward County for services provided to eligible clients starting on the effective date. Staff anticipates that service providers may not meet all outcomes during this Fiscal Year and requests additional flexibility to accommodate extenuating or unanticipated circumstances, whether due to the COVID-19 pandemic or for other reasons. For example, one service provider recommended for funding reallocation met just two of three outcomes for the second quarter of Fiscal Year 2021-2022 (Exhibit 2). Staff is working with this service provider to improve future outcome attainment.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which... is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion I) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached to this report as Exhibit 3 and constitute full disclosure of any existing conflict.

Fiscal Impact/Cost Summary

Funds are allocated in the HSD, Community Partnerships Division (“CPD”), Fiscal Year 2021-2022 budget. The Fort Lauderdale Hollywood Airport will reimburse the HSD CPD for the increases to the Agreement amounts for TaskForce Fore Ending Homelessness, Inc., and the South Broward Hospital District d/b/a Memorial Healthcare System.
