Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Value of “Encouraging investments in renewable energy, sustainable practices, and environmental protection” and Goal 1: “Seek funding for, implement policies and pursue projects promoting the use of alternative energies and sustainable practices.”

 

NPDES-MS4 Permit No. FLS000016-003 was issued pursuant to 40 CFR 122.26 and Section 403.0885 F.S. on January 5, 2017, to authorize the County and its 28 co-permittees, including FDOT District 4, to discharge to waters of the State in accordance with the approved stormwater management programs, effluent limitations, monitoring requirements, and other provisions, as set forth in the permit.  A JPA by and between Broward County and FDOT District 4 was executed on December 5, 2017 (Exhibit 1).  The 2017 JPA authorized cost sharing payments to Broward County, for a total of $99,904 through January 4, 2022, for the technical activities required by the NPDES-MS4 Permit.  This amendment to the JPA (see Exhibit 2) adds $24,582 to the cost sharing payments and extends the JPA terms through January 4, 2023.

 

Retroactive approval is being requested because the amended JPA was not finalized until May 11, 2022.

The amendment to the JPA has been reviewed and approved as to form by the Office of the County Attorney.
