A. MOTION TO AUTHORIZE County Administrator to amend the Broward County Five Year Strategic Consolidated Plans for Fiscal Years 2015-2019 and Fiscal Years 2020-2024 and the accompanying Annual Action Plans for the U.S. Department of Housing and Urban Development ("HUD") Community Planning and Development Grants; to make necessary project/activity eligibility and programmatic changes; reprogramming funds and revising Coronavirus Aid, Relief, and Economic Security (CARES) Act Community Development Block Grant CARES (CDBG-CV, and CV3) funds, CDBG-CV2 funds awarded through the state of Florida Department of Economic Development, Community Development Block Grant ("CDBG"), Home Investment Partnerships American Rescue Plan Program (HOME-ARP), Home Investment Partnerships (HOME) grant, and Emergency Solutions Cares Act Grants (ESG-CV2) based on the recommendations in Exhibit 1; authorizing the County Administrator to take all necessary administrative and budgetary actions for implementation of the changes, to submit a copy of the amendment to HUD, and to execute agreements, amendments, reinstatements and interlocal agreements with subrecipients and/or contractors/developers for funding for the respective CDBG-CV, CDBG, ESG, ESG-CV and HOME Programs, subject to approval as to form by the Office of the County Attorney.

MOTION TO AUTHORIZE County Administrator to take all necessary administrative and budgetary actions to appropriate and implement unanticipated Community Development Block Home Investment Partnerships Program Grant (HOME) revenue funds in the amount of $718,847, of which a maximum of 10% may be administrative funds, based on the recommendations in Exhibit 1, and authorize County Administrator to execute agreements, and/or amendments to existing subrecipient agreements to allocate the funds, subject to approval as to form by the Office of the County Attorney.

Why Action is Necessary
Motion A: Board action is required to amend HUD Five Year Strategic Consolidated Plans and Annual Action Plans to reprogram/reallocate funding allocations and priorities, implement substantial changes, and execute agreements and amendments to implement such changes.
Motion B: Board approval is required to appropriate anticipated and unanticipated funds and amend the County’s HUD Five Year Strategic Consolidated Plans and Annual Action Plans to implement substantial changes to program funding allocations and priorities; and subsequently appropriate unanticipated funds to interlocal agreements with other municipalities.
What Action Accomplishes
Motion A: Approves changes to the Five Year Strategic Consolidated Plans and associated Annual Action Plans, and subsequent budgetary and administrative actions.
Motion B: This action allows the County Administrator to recognize unanticipated grant funds, allocate these funds in accordance with the recommendations, and take subsequent budgetary and administrative action.

Summary Explanation/Background
THE RESILIENT ENVIRONMENT DEPARTMENT AND HOUSING FINANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This item supports the Board's value: Offering sustainable, compatible, innovative housing options for all income-levels, including integrated, permanent supportive housing, and the corresponding goal of increasing the availability of affordable housing of all types, countywide in every community using effective, uniform criteria, policies, and strategies.
Motion A.
This motion allows the County to make the necessary changes to the Five Year Strategic Consolidated Plans and associated Annual Action Plans, make necessary regulatory, project eligibility and programmatic changes, and subsequent budgetary and administrative actions detailed in Exhibit 1.
Community Development Block Grant (CDBG)
CDBG Remaining Balances from Subrecipients Reallocated to Broward County Housing Finance Division (HFD) Countywide Housing Projects
The following Cities/Subrecipients have remaining balances and will be reallocated to Broward County Countywide Housing Projects/Activities, as detailed in Exhibit 1:
• Broward County Housing Authority
• City of Cooper City
• City of Hallandale Beach
• City of Lauderdale Lakes
• City of Lighthouse Point
• City of Oakland Park/Area Agency on Aging
• City of Parkland
• City of North Lauderdale
CDBG Remaining Balances and/or Reallocation to other Subrecipient/City Projects/Activities.
The following Cities/Subrecipients have remaining balances and/or have requested the reallocation of their funds into other City Projects/Activities, as detailed in Exhibit 1:
• City of Oakland Park
• City of North Lauderdale
CDBG - Housing Finance Division (HFD) Housing Projects/Activities Reallocations
The HFD has requested the reallocation of Purchase Assistance Activity to Housing Rehabilitation Activity within the Housing Project funds, to meet current demand, as detailed in Exhibit 1.
Emergency Solutions Grant (ESG)
ESG Remaining Balances Reallocated to other Countywide Projects/Activities
The following Subrecipients have remaining balances and will be reallocated to Broward County Countywide Housing Projects/Activities, as detailed in Exhibit 1:

HOME Remaining Balances and/or Reallocation to other Subrecipient/City Projects/Activities.
The following Cities/Subrecipients have remaining balances and/or have requested the reallocation of their funds into other City Projects/Activities, as detailed in Exhibit 1:
• City of Sunrise
CARES Act/Coronavirus Funds
CDBG-CV1, CDBG-CV2, CDBG-CV3, and ESG-CV2 funds were previously allocated to Rental Assistance/Meals, and Homeless Prevention Projects/Activities per Agenda Item No. 20, on the June 2, 2020, Board of County Commissioners (BOCC) meeting, and Agenda Item No. 30, on the June 1, 2021, BOCC meeting. Since that time, the County has received over $85,945,843 in funding from federal emergency rental assistance programs through the Consolidated Appropriations Act and the American Rescue Plan Act. These larger federal assistance funds are less stringent and provide longer assistance periods than the CDBG-CV and ESG-CV funds. Both the CDBG-CV funds and the ESG-CV funds have upcoming deadlines (50% of the ESG-CV funds by September 15, 2022, and 80% of the CDBG-CV funds by September 2023).
There was a subsequent Item, Agenda Item No. 16, on the May 10, 2022, BOCC meeting reallocating a maximum of $2.5 million of ESG-CV32 funds to Henderson Mental Health for single-family/multi-family acquisition and/or acquisition and rehabilitation activity for temporary emergency shelter services, as permitted by the CARES Act. Due to the stringent time constraints and the housing/real-estate market, Henderson will not be able to utilize the funding by the HUD imposed deadlines (June, 2022 and September, 2022). The HFD is proposing to reallocate the necessary amount to meet the expenditure timeline to Costs (or previously incurred costs) preparing for, or as a result of Coronavirus (Essential Services, and/or Eligible Shelter Operations and HMIS Eligible activities). The HFD will conduct additional outreach to the Continuum of Care/Emergency Shelter recipient organizations, and other non-profit organizations, as necessary.
The HFD is requesting the reallocation of these funds to the recommended Projects/Activities detailed in Exhibit 1.
Motion B
This motion allows the County to recognize unanticipated/program income (PI) grant funds, and County Administrator to take all necessary Administrative and Budgetary Actions. The grant funds being recognized are detailed in Exhibit 1.

HOME Grant Unanticipated Revenue/Program Income (PI) is being recognized in the amount of $718,846, of which a maximum of 10% may be administrative funds, for the recommendations as detailed in Exhibit 1.
