Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

West Prospect Road is a County road located in the City of Tamarac. The City of Tamarac desires to improve the aesthetics of the Prospect Road corridor and buffer the residents of the Tamarac Lakes Section One and Section Two communities by installing a buffer wall along Prospect Road. The wall will replace a mixture of wood and chain link fences, pipe handrail, and low concrete walls with a uniform 6-foot-tall, aesthetically pleasing concrete wall along the rear of 29 residences, and at the two subdivision entrances. The proposed wall will provide a significant aesthetic improvement and consistency in the materials used along the corridor.

When the City evaluated installing the proposed wall on the 29 private properties along Prospect Road, they identified several conflicts at the proposed location of the wall on those properties including concrete slabs, pools, trees, and sheds. As a result, the City indicated a desire to minimize the impact to the homeowners by seeking to install the wall within a minimal amount, approximately 2.5 feet, of the County’s right-of-way under a Revocable License Agreement. The City will also be widening the sidewalk located along this section of Prospect Road. The installation of the wall will not affect the function of the road. All costs for the construction of the wall and sidewalk will be paid by the City.

This item seeks Board approval of a Revocable License Agreement between Broward County and the City of Tamarac for the installation and maintenance of approximately 2,200 linear feet of precast system buffer wall, together with associated concrete sidewalk improvements, within County right-of-way on the north side of Prospect Road (Exhibit 1). The wall will begin approximately 400 feet east of NW 21st Avenue and end approximately 125 feet west of the City of Tamarac’s east city limits. Exhibit 2 is a location map of the Revocable License Area.

The Agreement will allow the City to install the wall within County right-of-way and will obligate the City to maintain the wall. The County can terminate the Agreement with or without cause at any time. If the Agreement is terminated, the City must remove all improvements within the licensed right-of-way and restore the area to its original condition or to such condition as approved in writing by the Contract Administrator.

The Agreement has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
