Why Action is Necessary

Board approval is necessary to authorize the County Administrator to execute agreements with other entities.

 

What Action Accomplishes

Authorizes the County Administrator to execute the Memorandum of Understanding (MOU) between Broward County and the State of Florida Department of Highway Safety and Motor Vehicles (DHSMV). The DHSMV has requested that all Tax Collectors enter into an updated MOU to support uniformity throughout the State.

Summary Explanation/Background

THE FINANCE AND ADMINISTRATIVE SERVICES DEPARTMENT AND THE RECORDS, TAXES AND TREASURY DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The DHSMV recently revised the Memorandum of Understanding maintained between the DHSMV and the various Tax Collectors throughout the State of Florida.

 

Pursuant to Chapters 319 and 320, Florida Statutes, the Tax Collector is mandated to perform the statutory duties as an Agent of the DHSMV for transactions primarily related to motor vehicle and vessel tags, titles, and registrations. The current MOU was executed by Broward County's Mayor on February 2, 2016. The DHSMV has provided a revised MOU to all Tax Collector offices and is requiring all Tax Collectors to execute the MOU as confirmation of adherence to all applicable rules and regulations pertaining to Agent functions, and to support uniformity throughout the State.

 

Approval of this agreement will continue recurring payments from the DHSMV to Broward County of $3.00 per transaction related to vehicle registration renewals which are tendered online through the DHSMV website.

 

The form of the agreement is dictated by the DHSMV and is not subject to negotiation or inclusion of the County’s normal contract provisions.  The MOU is for a four-year term with an optional extension of another four years if approved by both parties. It should be noted that these functions will transfer to the newly established office of Tax Collector in 2025. The venue is Leon County for issues that arise that cannot be resolved between the parties.

Fiscal Impact/Cost Summary

This action will allow Broward County to continue to receive $3.00 per transaction for those transactions collected via DHSMV's "Go-Renew" online vehicle and vessel registration renewal website. Approximately 712,000 transactions are currently processed using DHSMV's website, so it is estimated that Broward County will receive approximately $2,136,000 per year for these transactions.

 

The revenues collected from these transactions will be booked to the appropriate General Fund revenue.
