Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL.

 

Rock Island Road is a County Road in the City of Tamarac. CH Realty IX-Taylor/Theus I Miami Tamarac, L.P. and the City of Tamarac desire to improve a portion of the County right-of-way along the east side of Rock Island Road north of West Commercial Boulevard.

 

This item seeks Board approval of a Revocable License Agreement between Broward County, CH Realty IX-Taylor/Theus I Miami Tamarac, L.P. and the City of Tamarac for installation and maintenance of improvements along the east side of Rock Island Road north of West Commercial Boulevard (Exhibit 1). Exhibit 2 is a location map of the Revocable License Area.

 

The proposed improvement includes the installation of landscaping for an area approximately 270 feet long and 28 feet wide along the east side of Rock Island Road north of West Commercial Boulevard in the City of Tamarac. The landscaping improvements shall incorporate a minimum 50% native species by plant types and shall follow the Broward County NatureScape program and Florida-Friendly Landscaping principles. The Agreement will allow CH Realty IX-Taylor/Theus I Miami Tamarac, L.P. and the City of Tamarac to install the improvements within County right-of-way. CH Realty IX-Taylor/Theus I Miami Tamarac, L.P. will be obligated to maintain these improvements. In the event that CH Realty IX-Taylor/Theus I Miami Tamarac, L.P. fails to maintain the improvements, the City of Tamarac is obligated to perform the maintenance. The County can terminate the Agreement with or without cause. If the Agreement is terminated, CH Realty IX-Taylor/Theus I Miami Tamarac, L.P. must remove all improvements within the licensed right-of-way and restore the area to its original condition or to such condition as approved in writing by the Contract Administrator.

 

The Agreement has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
