MOTION TO APPROVE Public Transportation Grant Agreement (“PTGA”) between the Florida Department of Transportation (“FDOT”) and Broward County for Financial Project No. 449838-1-94-01, with FDOT agreeing to grant up to $3,700,000 to Broward County for Port Everglades’ Southport Upland Cargo Improvements Project (“Project”), but no more than 50% of the total eligible cost of the Project, and County agreeing to match FDOT’s grant and cover any cost overruns, and Addendum thereto modifying the indemnification language of the PTGA; authorize the Mayor and Clerk to execute the PTGA and Addendum; authorize the County Administrator or designee to take the necessary administrative and budgetary actions resulting from approval of the PTGA; and authorize the County Administrator to approve any amendments to the PTGA that do not increase the County’s financial obligation, subject to review by the Office of the County Attorney for legal sufficiency.

What Action Accomplishes
Execution of the PTGA and Addendum provides grant funding from FDOT for the Environmental/Design/Construction phase of Port Everglades’ Southport Upland Cargo Improvements Project. The County Administrator is delegated authority to take the necessary administrative and budgetary actions to implement the PTGA, and to approve any future non-monetary amendments to the PTGA.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This item supports the Broward County Board of County Commissioners’ (“Board”) Value of "Ensuring economic opportunities for Broward’s diverse population and businesses" and the Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs."
The Port Everglades Southport Upland Cargo Improvements Project includes the construction of an approximately 22.5-acre container yard (Phase IXA) in Southport. This project is north of the Southport Turning Notch Expansion (STNE) Project. This container yard is being constructed on the former location of the Port's Foreign-Trade Zone No. 25 warehouses, which are being demolished as part of the Project. The previous tenants in the Port warehouses have either moved to locations off the port or to the Port Everglades International Logistics Center (PE-ILC) warehouses operated by CenterPoint Port Everglades, LLC, located within the port on the west side of McIntosh Road. Approximately 17.5 acres of additional land that was excavated and improved as part of the STNE Project will be added to Phase IXA, resulting in a total of 40 acres of new container yard north of the STNE.
FDOT has approved for Fiscal Year 2022-2023 the disbursement of up to $3,700,000 (total FDOT contribution not to exceed 50% of total eligible cost) under this PTGA, which requires matching funds from the County in the amount of $3,700,000 (50% of total eligible cost), for a total Project cost under the PTGA of $7,400,000. The County is responsible for fully funding any cost overruns above the total Project cost. The PTGA also includes an Addendum modifying the standard Indemnification language included in the PTGA.
A requirement for this funding is to execute this PTGA between FDOT and Broward County prior to disbursement of any funding. This PTGA is written in the standard FDOT format and has been approved as to form by the Office of the County Attorney. FDOT will execute the PTGA and Addendum after Board approval.
