Summary Explanation/Background

THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.

 

This item supports the Broward County Board of County Commissioners’ (“Board”) Value of "Ensuring economic opportunities for Broward’s diverse population and businesses" and the Goal to "Increase the economic strength and impact of revenue-generating County enterprises balancing economic, environmental, and community needs."

 

On November 7, 2017 (Item No. 11), for Fiscal Year 2017-2018, the Board approved a Joint Participation Agreement (“JPA”) between Broward County and FDOT for Financial Project No. 430123-1-94-02 for partial funding of the costs associated with the Port Everglades Slip 1 (Berths 9 & 10) widening Project (“Project”). The JPA approved a Project cost of up to $6,800,000 and provided grant funding from FDOT to Broward County in the amount of the lesser of $3,400,000 or 50% of the Project cost.  The County was required to provide the greater of $3,400,000 or 50% of the Project cost.

 

For Fiscal Year 2021-2022, FDOT recommended adjusting State funding to align more closely with the timing of possible expenditures as per the updated Project schedule and to increase the state’s cost share of eligible project costs from 50% to 75%. On December 11, 2021 (Item No. 11), the Board approved the termination of the original Fiscal Year 2017-2018 JPA as part of said schedule adjustment and approved a new PTGA recommitting the $3,400,000 of funds released from the terminated JPA and an additional $3,000,000 of state funding for a new total of up to $6,400,000, not to exceed 75% of the total Project cost, with Broward County bearing expenses in excess of FDOT’s funding. With the execution of the PTGA, total Project costs were estimated at $8,533,334.

 

FDOT has approved for Fiscal Year 2022-2023 the disbursement of an additional $19,600,000 (total FDOT contribution not to exceed 75% of total eligible cost) under this PTGA Amendment No. 01, which requires matching funds from the County in the amount of $6,533,333 (25% of total eligible cost), bringing the total Project cost under this PTGA to $34,666,667.  With the approval of the Amendment, FDOT’s contribution towards the total Project cost would be up to $26,000,000, and the County’s match would be up to $8,666,667.

 

The Project will widen Slip 1 to the south by approximately 150 linear feet and will include the installation of new bulkheads. Completion of this project is needed to accommodate larger petroleum tanker vessels, resulting in increased safety, additional capacity, and higher potential throughput.

 

A requirement of this additional funding is to execute this PTGA Amendment No. 01 between FDOT and Broward County prior to disbursement of any funding. This PTGA Amendment is written in the standard FDOT format and has been approved as to form by the Office of the County Attorney. FDOT will execute the Amendment after Board approval.
