Why Action is Necessary

Pursuant to Section 21.53 of the Broward County Administrative Code, contracts that exceed a term of five years require Board approval. Board approval is also required to designate the Director of the Animal Care Division to execute Transfer Partner Agreements on behalf of the County.

Authorizes the Animal Care Division to enter into agreements with Transfer Partners using the approved template.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE ANIMAL CARE DIVISION (ACD) RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

Approval of these motions will permit ACD to enter into agreements with Transfer Partners using the attached standard form agreement (Exhibit 1).

 

Animal Care Division works with over 170 Transfer Partners, non-profits dedicated to taking custody of and rehoming ACD pets. This effort reflects two of the four pillars from the reset of Animal Care (May 11, 2021, Budget Workshop). The two pillars are: 1) Community Animal Care (working with the community to rehome pets and keep pets out of the shelter); and 2) Public Safety (vetting Transfer Partners to ensure protection of public safety and pet welfare).

 

The current Transfer Partner Agreement is outdated and ACD has worked with the Office of the County Attorney to revise the Agreement (Exhibit 1). Changes from the previous agreement include: changing the title from Rescue Partner Agreement to Transfer Partner Agreement; adding a Transfer Partner definition; updating contract language to include certain conditions (Fees, Adoption of an Animal, Indemnification, Public Records, Sovereign Immunity, and Use of County Logo); simplification, by reference to Florida Statutes, of the Sterilization and Vaccination conditions; and refining the Social Media condition as a Non-Disparagement condition.

 

Existing Transfer Partners will be required to execute the new Transfer Partner Agreement during their annual review.

 

The agreement has been approved as to form by the Office of the County Attorney.
