Why Action is Necessary

A. Broward County Board of County Commissioners (“Commission”) adoption of this Resolution is required for appropriation and disbursement of funds for agreements with external agencies and to authorize the County Administrator to execute agreements.

 

B. Section 23.2 of the Broward County Administrative Code requires Commission approval of a Single Source Determination.

 

C. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.

 

What Action Accomplishes

Adoption of Motion A authorizes funding for agencies to assist the Human Services Department in providing a range of services that address the multifaceted needs of a growing and diverse client population in Broward County using a collaborative, comprehensive, and integrated approach.

 

Approval of Motion B allows Broward County to match funds in the Florida Child Care Executive Partnership childcare purchasing pool for the provision of childcare subsidies and other supportive services for low-income families in Broward County.

 

Approval of Motion C waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “approaching human services collaboratively and compassionately with special emphasis on the most vulnerable,” and the goal to “effectively advocate for and acquire municipal, state and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care.” The appropriated funding supports services that focus on child and adult behavioral health or special health and improves the economic and housing stability of Broward County residents. It also expands support services offered by providers in specified existing agreements to increase funding utilization.

 

Commission approval is requested for Fiscal Year 2022-2023 funding recommendations for service provider agreements identified in Exhibit 1, Attachment A, as New (“N”), New Single Source Determination (“NSSD”), and Renewal (“R”) agreements, in addition to Extensions (“E”) of previously approved agreements.

 

On March 30, 2022, the Director of the Purchasing Division approved a NSSD for The Early Learning Coalition of Broward County, Inc., as the only agency to develop and administer the state system of childcare services in Broward County (Exhibit 4).

 

HSD requests Commission approval to renew and extend agreements with specified service providers identified in Exhibit 1, Attachment A. Services to be renewed were initially awarded under a prior Request for Proposals (“RFP”) and are recommended for continued funding in Fiscal Year 2022-2023. HSD also requests approval for one-year extensions of two agreements, extensions of two services for a period of up to six months. The extensions are requested to allow HSD staff time to complete a RFP. This item also requests Commission approval to add a new program to an existing Agreement with The Salvation Army to provide emergency shelter beds at their facility for unhoused people at the airport. Letters of Support from the Children’s Services Board (Exhibit 2) and the Homeless Continuum of Care Board (Exhibit 3) are attached.

 

Within the general fund contracted programs administered by the HSD, service providers achieved 99% of outcome indicators for the last complete Fiscal Year (Exhibit 1, Attachment B).

 

Staff will utilize the revised standard form agreement (Exhibit 1, Attachment C). The Office of the County Attorney will review agreements and amendments for legal sufficiency prior to execution by the County Administrator. Also, this item will approve the terms of a standard form agreement in substantially the form set forth in Attachment C, which includes the authority to implement a streamlined contracting process for the substantially same terms using a simple cover agreement that references the full terms and conditions as available online at a designated website.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion C) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached to this report as Exhibit 5 and constitute full disclosure of any existing conflict.
