Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

On February 27, 2018 (Item No. 2), and on March 20, 2018 (Item No. 77), the Board approved shell TDMS ILAs between Broward County and government entities for the use of Temporary Debris Management Sites (TDMS). The County operates the TDMS to process debris following weather-related events or disasters. Each government entity that is a party to a TDMS ILA with the County is invoiced its proportionate share for services provided to that entity.

Under the terms of the TDMS ILAs, the government entities entering into an agreement with the County for the use of the TDMS must execute the applicable agreement by a particular calendar date to be eligible to use the TDMS for the hurricane season in that calendar year.

Both TDMS ILAs provide for two five-year renewals upon mutual consent.

If approved, Motion A will authorize the County Administrator, or designee, in her sole discretion to waive the annual execution deadlines for both the TDMS ILAs, increasing access to the TDMS and disposal services within the same calendar year to government entities.

If approved, Motion B will authorize the County Administrator to approve and execute minor amendments to the TDMS ILAs and exercise the renewal terms provided therein. Each such amendment will be subject to review for legal sufficiency by the Office of the County Attorney.
