What Action Accomplishes

Approval of Motion A aligns the South Broward Hospital District d/b/a Memorial Healthcare System (“Memorial”) medical services agreement (“Agreement”) term with the North Broward Hospital District d/b/a Broward Health (“Broward Health”) medical services agreement term that ends September 30, 2023 and increases Memorial’s reimbursement rates for the contracted medical services.

 

Approval of Motion B waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “approaching human services collaboratively and compassionately, with special emphasis on the most vulnerable” and the goal to “collaborate with public and private partners to find creative, equitable, and responsible solutions to systemic community problems, especially permanent, supportive housing for persons experiencing, or at risk of, homelessness.” Commission approval will renew the Agreement to align with Broward Health’s agreement and provide Broward County continued compliance with the applicable state statute. 

 

On February 26, 2019 (Item No. 6), the Commission approved Agreement No. 18-CP-HCS-8312-01 between Broward County and Memorial to set reimbursement rates for medical services provided to persons injured or ill during or at the time of an arrest (“medical services”). The Agreement ends September 30, 2022. No performance outcomes were assigned to the billing Agreement.

 

The First Amendment extends the Agreement for one year and aligns the term with the Broward Health arrestee Agreement. The First Amendment also includes a 4.5% reimbursement rate increase for the medical services. The increase is based upon the May 2022 Consumer Price Index. The adjusted daily rate is $2,437 for inpatient services and $642 for outpatient services. No performance outcomes are assigned to this billing Agreement. The First Amendment will be reviewed and approved as to form by the Office of the County Attorney prior to execution by the County Administrator.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached to this report as Exhibit 1 and constitute full disclosure of any existing conflict.

Funding up to $2,775,000 is allocated as part of the Recommended Fiscal Year 2023 budget for reimbursements for medical services under this Agreement, as well as the other tax-assisted hospital district and private hospitals.
