Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

The purpose of this contract is to provide all labor, materials, equipment, and incidentals necessary for the installation of new fences and repair or replacement of existing fences for the Broward County Port Everglades Department and other County agencies on an as needed basis.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT/FACILITIES MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) designated this solicitation reserved for certified County Business Enterprises (CBE). Coast to Coast Garage Door, LLC is a certified CBE firm, which has been reviewed and approved by OESBD (Exhibit 2).

 

The purpose of this contract is to provide all labor, materials, equipment, and incidentals necessary for the installation of new fences and repair or replacement of existing fences for the Broward County Port Everglades Department and other County agencies on an as needed basis. All prices, terms and conditions will remain fixed for the initial one-year contract period. Upon completion of the initial contract period, the contractor may make a timely request for an annual price adjustment, prior to the renewal date, for years two through five, in accordance with the price adjustment clause term of the contract. The initial contract period begins on the date of award and terminates one year from that date.

 

The allowances incorporated in the contract in the total estimated annual amount of $85,000 includes $60,000 for parts and materials and $25,000 for permit fees. Expenditures under these allowance items must be approved by the contract administrator; and will be reimbursed at the contractor’s actual incurred cost, without markup (Exhibit 1).

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. Coast to Coast Garage Door, LLC has agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

Neither Bauer Fence Construction Corporation, the apparent low bidder, nor GD Services, LLC provided the required bid bond as indicated in the solicitation. Pursuant to the solicitation’s bid bond, bid security, performance and payment security, and qualifications of surety requirements, the bid security shall be in an amount equal to 5% of the total price offered. The Director of Purchasing deemed both Bauer Fence Construction Corporation and GD Supplies, LLC to be non-responsive to the solicitation’s bid bond requirements. Additionally, GD Services, LLC was determined to be noncompliant to the solicitation’s CBE requirements.

 

The Port Everglades Facilities Maintenance Division reviewed the bid submitted by Coast to Coast Garage Door, LLC and concurs with the recommendation for award (Exhibit 3). Two performance evaluations have been completed for Coast to Coast Garage Door, LLC; the firm has an overall rating of 4.98 out of a possible 5.  Copies of Coast to Coast Garage Door, LLC’s vendor performance evaluations are available upon request.

 

The Purchasing Division has researched the prices submitted by the recommended bidder, Coast to Coast Garage Door, LLC, and determined that the prices submitted are fair and reasonable in comparison to prices of competing firms and the previous contract’s prices (Exhibit 4). Coast to Coast Garage Door, LLC was provided an opportunity to offer a voluntary price reduction, which the firm declined stating it could not reduce any of the price.

 

Incumbent: Bauer Construction Corp.; Contract Title: Fencing - New, Repair and Replacement Services; Contract No. BLD2120810X1; Contract Term: March 15, 2020 through September 15, 2020; Expenditures: $472,191.66.

 

The Recommendation for Award was posted on the Purchasing Division website from July 20, 2022 through July 26, 2022. There was no protest or appeal filed against this procurement.

 

The bid was posted on May 13, 2022 and opened on June 15, 2022; three bids were received with no declination (Exhibit 1).
