MOTION TO AUTHORIZE County Administrator to execute Three Party Escrow Agreement between Broward County, the Florida Department of Transportation, and the State of Florida, Department of Financial Services, Division of Treasury (Escrow Agent), providing for the County to deposit the total estimated cost of $691,651 into an escrow account to fund construction of the County’s Adaptive Traffic Control System along SR 842/Broward Boulevard from west of NW 42nd Avenue to west of SW 22nd Avenue. (Commission Districts 5, 8 and 9)

Why Action is Necessary
A. Board of County Commissioners’ approval is required to enter into legal agreements with the Florida Department of Transportation.
B. Board of County Commissioners' approval is required to authorize the County Administrator to execute agreements with other governmental agencies.
What Action Accomplishes
A. Provides funding from Broward County to the Florida Department of Transportation (FDOT) for construction of an Adaptive Traffic Control System along SR 842/Broward Boulevard from west of NW 42nd Avenue to west of SW 22nd Avenue to be included as part of FDOT’s roadway improvements project.
B. Authorizes County Administrator to execute Three Party Escrow Agreement with FDOT and the State of Florida, Department of Financial Services, Division of Treasury for payment from the County to an escrow account to fund construction of the County’s Adaptive Traffic Control System along SR 842/Broward Boulevard from west of NW 42nd Avenue to west of SW 22nd Avenue.

Summary Explanation/Background
PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL
This item supports the Board of County Commissioners' Value of "cooperatively delivering an efficient and accessible regional intermodal transportation network" with the Goal of supporting "the development, design and construction of sustainable, multi-modal transportation facilities throughout the County, to meet the demands of residents, travelers, and businesses."
As part of the Broward County Mobility Advancement Program, Adaptive Traffic Control Systems (ATCS) are being installed throughout the County. The FDOT roadway improvements project along Broward Boulevard overlaps with the County’s planned ATCS installations along SR 842/Broward Boulevard from west of NW 42nd Avenue to west of SW 22nd Avenue. Broward County and FDOT have determined that it is in their mutual interest to include the County’s work in the FDOT project. Broward County’s contributions to FDOT provide for engineering design and construction costs for County ATCS deployment within the limits of the FDOT project.
On November 10, 2020 (Item No. 6), the Board of County Commissioners approved a Locally Funded Agreement with FDOT for engineering design services of an Adaptive Traffic Control System along SR 842/Broward Boulevard from west of NW 42nd Avenue to west of SW 22nd Avenue to be included as part of FDOT’s roadway improvements project, at a cost of $131,637 to the County. The design is now complete.
Motion A seeks Board approval of a Locally Funded Agreement between Broward County and FDOT to provide for the County to pay FDOT the estimated amount of $691,651 to incorporate the County’s Adaptive Traffic Control System into the FDOT’s construction project (Exhibit 1). The total estimated cost of FDOT’s construction project including the County portion of the work is $7,313,819.
Motion B seeks Board approval to authorize the County Administrator to execute a Three Party Escrow Agreement with FDOT and the State of Florida, Department of Financial Services, Division of Treasury providing payment for the County’s Adaptive Traffic Control System to be incorporated into FDOT’s roadway improvements project (Exhibit 2). FDOT requires payment in full for the County’s cost of $691,651 within 30 days of execution by FDOT of the Locally Funded Agreement in Motion A.
The Locally Funded Agreement and the Three Party Escrow Agreement have been reviewed and approved as to form by the Office of the County Attorney.
