AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE REPEAL OF OBSOLETE OR OUTDATED PROVISIONS IN CHAPTERS 15, 17, 21, AND 23 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); REPEALING SECTION 15-5 RELATING TO THE ESTABLISHMENT OF A WISHING WELL, SECTIONS 15-6 THROUGH 15-9 RELATING TO ANNUAL APPROPRIATIONS TO VARIOUS ENTITIES, SECTION 15-12 RELATING TO THE APPROPRIATION AND DISBURSEMENT OF COUNTY FUNDS TO NONPROFIT ORGANIZATIONS, CHAPTER 17 RELATING TO JUNK AND JUNK DEALERS, ARTICLE X OF CHAPTER 21 RELATING TO CONVENIENCE STORE SECURITY, AND SECTION 23-1 RELATING TO REQUIRED EQUIPMENT FOR BICYCLES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
On August 25, 2022, the Board of County Commissioners directed the Office of the County Attorney to prepare Ordinances to amend or repeal outdated or obsolete provisions of the Broward County Code of Ordinances ("Code") and present such Ordinances for consideration by the Board. Consistent with this direction, a series of proposed Ordinances will be presented for Board consideration in 2022 and 2023. This proposed Ordinance repeals the following sections of the Code that are obsolete and no longer consistent with the County's current practice:
• Section 15-5, enacted in 1965, permitting a wishing well and establishing a plaque at the courthouse for disabled children and adults;
• Sections 15-6 through 15-9, all originally enacted in the 1960s, authorizing certain donations, including to entities that are now defunct;
• Section 15-12, authorizing appropriation of funds to certain nonprofit organizations for Fiscal Year 1986;
• Chapter 17, regulating junk dealers and scrap metal processors, which is duplicative of regulations found in Part II of Chapter 538, Florida Statutes;
• Article X of Chapter 21, establishing minimum security requirements for convenience stores in unincorporated areas of Broward County, which is duplicative of security requirements for convenience stores listed in Section 812.173, Florida Statutes; and
• Section 23-1, requiring certain equipment for bicycles, which is duplicative of the requirements for bicycle equipment listed in Section 316.2065, Florida Statutes.
