Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/CONSTRUCTION MANAGEMENT DIVISION RECOMMENDS APPROVAL.

 

The Office of Economic and Small Business Development established a County Business Enterprise (CBE) participation goal of 30% for each project.

 

On June 11, 2019 (Item No. 77), the Board of County Commissioners approved Request for Proposals (RFP) No. PNC2119163P1, to select a Managing General Contractor for Broward County Judicial Projects. Described work assignments include projects at the Broward County Judicial Complex (“BCJC”) (downtown campus), the South Garage, the Coca-Cola Building, the South Regional Courthouse replacement project, selected projects at the Main Jail, and various projects within the satellite courthouses.

 

On November 18, 2019, the County Administrator approved the ranking order for RFP No: PNC2119163P1, Managing General Contractor (“MGC”) for Broward County Judicial Projects, and established Stiles Pirtle Joint Venture as the Number One Ranked Firm.

 

On September 22, 2020, the County Administrator approved, through Board Action given on September 10, 2020 (Item No. 59), the Construction Agreement for Managing General Contractor with the Stiles Pirtle Joint Venture.  In addition to construction phase services, the MGC's services include pre-construction, design and constructability reviews, estimating, scheduling, CBE recruitment and contracting, subcontractor bidding, occupancy assistance and warranty services.

 

The First Amendment to the Agreement increased the funding to the Owner’s Allowance accounts for the listed projects in Exhibit B-1 to allow County staff the flexibility to address fluctuations in pricing of construction costs resulting from the ongoing pandemic, as necessary.

 

While originally advertised to be included in the RFP for this agreement, the value of the South Regional Courthouse Replacement Project was yet undetermined and not included in the approved “Schedule of Estimated Guaranteed Maximum Prices.” This Second Amendment incorporates the South Regional Courthouse Replacement Project as part of the Managing General Contractor Agreement with Stiles Pirtle Joint Venture for Judicial Projects. 

 

A Pre-design study has been completed for the programming of an approximately 182,000 square foot Courthouse, ancillary areas, and Parking Garage. The replacement facilities may be constructed on the site of the existing South Regional Courthouse or alternate site(s) as approved by the County.

 

This Second Amendment has been reviewed and approved by the Office of the County Attorney.

The estimated Guaranteed Maximum Price (EGMP) for the South Regional Courthouse Replacement Project is $152,796,333. A portion of the estimated GMP will be negotiated for pre-construction services as needed. Funds have not been appropriated for the South Regional Courthouse Project.
