Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “approaching human services collaboratively and compassionately, with special emphasis on the most vulnerable” and the goal to “effectively advocate for and acquire municipal, state and federal financial support to equitably address health and human services needs of the entire community, through a truly coordinated system of care.” The funding supports the system of care for youth experiencing serious emotional disturbance and those with early signs and symptoms of serious mental illness.

 

Broward County has received federal funds from the U.S. Department of Health and Human Services, Substance Abuse and Mental Health Services Administration (“SAMHSA”) since fiscal year 2002. Broward County collaborated with the designated managing entity, Broward Behavioral Health Coalition (“BBHC”), to submit the annual applications for One Community Partnership 3 Program (“OCP3”) services. On November 5, 2019, (Item No. 13), the Commission approved the appropriation and disbursement of funds to BBHC for OCP3 services.

 

On August 24, 2022, SAMHSA issued a notice of award (“NoA”) for the aggregate amount of $2,000,802 for the OCP3 grant’s fourth and final year, commencing September 30, 2022 (Exhibit 1). The aggregate SAMHSA award amount of $2,000,802 includes i) the amount of $69,180 that Broward County retains of the SAMHSA grant funds, ii) the amount of $16,854 Broward County provides as match, iii) the amount of $930,820 awarded to BBHC via a Third Amendment from Broward County for the September 30, 2022, through September 29, 2023 project period, iv) an external match in the amount of $983,948 provided by BBHC.

 

This item requests Commission approval for the County Administrator to execute a Third Amendment with BBHC in the amount of $930,820, effective retroactively from September 30, 2022, through September 29, 2023. Retroactive approval of this item is requested due to the delayed receipt of the NoA from SAMHSA.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached to this report as Exhibit 2 and constitutes full disclosure of any existing conflict.

Fiscal Impact/Cost Summary

The SAMHSA grant award for OCP3 is $2,000,802 from September 30, 2022, through September 29, 2023. The aggregate grant award amount includes $1,000,000 in grant funds.  Since SAMHSA requires a minimum match of 1:1 for this award, Broward County provides match funds in the amount of $16,854, and BBHC provides an external match in the amount of $983,948, for a total provided match amount of $1,000,802. The Broward County match amount of $16,854 is available in the Fiscal Year 2023 Community Partnerships Division budget.
