Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT/OPERATIONS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) designated this solicitation reserved for certified Small Business Enterprises (SBE). Over The Top Window Cleaning, Inc. is a certified SBE firm, which has been reviewed and approved by OESBD (Exhibit 2).
The purpose of this contract is to provide all necessary labor, equipment, tools, cleaning agents, supplies, aerial articulating/telescopic lift equipment, and any other items necessary to wash and clean all exterior glass window and door surfaces for single-story and multi-story cruise terminals and office buildings for the Broward County Port Everglades Department. All prices, terms and conditions will remain fixed for the initial one-year contract period. Upon completion of the initial contract period, the contractor may submit a price adjustment for approval, prior to the renewal dates, in accordance with the price adjustment clause term of the contract. The initial contract period begins on the date of award and terminates one year from that date.
In accordance with the Broward County Living Wage Ordinance, Section 26-101 (i), these services are covered services. Over The Top Window Cleaning Services, Inc. has agreed to be bound to the contractual obligations of the Living Wage Ordinance.
The Director of Purchasing determined the apparent low bidder, Blue Edonis, LLC, to be non-responsive for failure to comply with the requirements of the SBE Reserve (Exhibit 2).
The Port Everglades Department reviewed the bid submitted by the recommended bidder, Over The Top Window Cleaning, Inc., and concurs with the recommendation for award (Exhibit 3). There have been no performance evaluations completed for Over The Top Window Cleaning, Inc. within the past five years.
The Purchasing Division has reviewed the prices submitted by the recommended low, responsive, responsible bidder, Over The Top Window Cleaning, Inc., and determined that the prices submitted are fair and reasonable in comparison to prices of the competing firms and the pre-solicited estimated cost from the Agency (Exhibit 4).
The bid posted on June 17, 2022 and opened on July 6, 2022; four bids were received with zero declinations (Exhibit 1).
The Recommendation for Award was posted on the Purchasing Division website from August 15 - 19, 2022, at which time any aggrieved vendor could have protested the results. No protest or appeal was filed regarding this procurement.
