Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE BUILDING CODE DIVISION (BCD) RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

House Bill 423: Building Regulation ("HB 423") was enacted during the 2022 Legislative Session and requires local governments to charge a reasonable administrative fee based on actual costs incurred by those owners or contractors that retain a private provider (as defined in Section 553.791, Florida Statutes) to perform plan review or building inspection services. The proposed Resolution (Exhibit 1) amends the Broward County Administrative Code in order to implement the requirements of HB 423.

Fiscal Impact/Cost Summary

Due to a change in state law, if an owner or contractor retains a private provider for inspections then there would be a change in revenue received by the County of $66. In 19 years of experience one owner or contractor has opted to retain a private provider. The proposed changes to the Administrative Code do not result in a significant fiscal impact to the County given the volume of clients at this time utilizing private providers for this service.
