Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Open Market Area allows private waste collectors to provide non-exclusive collection, hauling, and transportation services for commercial solid waste generated within the Broward Municipal Services District (“BMSD”). The private waste collectors are paid for the services they provide by their commercial customers. Prior to providing such services, private collectors must first receive a license from Broward County Solid Waste and Recycling Services.

 

Section 14-84(b) of the Broward County Code of Ordinances (“Code”) provides that “when a new Open Market Area license is applied for or when a license is renewed, licensed private collectors shall supply the County, on a form and in a manner prescribed and approved by the Director of Solid Waste and Recycling Services, information concerning all accounts served within the designated unincorporated areas of the County, and a list of vehicles to be used within the County, including a VIN number, tag number and description of each vehicle.”

 

If this item is approved, after the private waste collectors submit applications for licenses and provide the information required by the Code, the County Administrator, or designee, will be authorized to approve and execute form license agreements with private waste collectors for commercial collection services within the Open Market Area of the BMSD, utilizing a form agreement reviewed for legal sufficiency by the Office of the County Attorney.

 

In addition, if approved, this item will retroactively ratify four Open Market Area license agreements previously executed on behalf of the County. Such license agreements currently are set to expire between September of 2022 and January of 2023 and will be replaced by the new form agreement being prepared by the Office of the County Attorney.
