Summary Explanation/Background

The Parks and Recreation Division has proposed the development of the Loggerhead Park Mooring Field at Hollywood North Beach Park (“Project”). The Project includes a total of 29 public mooring slips adjacent to the Intracoastal Waterway in the coves north and south of Sheridan Street. The Project facilities include floating docks for access to upland park facilities, a vessel sewage pump-out station, an exclusive use general services building with a laundry room, restroom/showers, and manager office, and other general site improvements. 

 

A portion of the Project, including 23 mooring slips, is located on sovereignty submerged land owned by the State of Florida and authorization is required from the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (“Board of Trustees”) to develop and operate the Project on this portion of the State’s submerged land. The Sovereignty Submerged Lands Fee Waived Lease agreement between the Board of Trustees (“Lessor”) and Broward County (“Lessee”) grants the County authorization to develop and operate these mooring slips on State owned land. The Lease is a standard form agreement from the Board of Trustees and provides that the County is responsible for all costs and attorneys' fees incurred to enforce the provisions of the Lease.

 

The Florida Department of Environmental Protection has issued Environmental Resource Permit no. 06-0376934-002-EI authorizing development of the Project with a condition of construction being the satisfactory execution of the Lease.

 

The Motion and the Lease have been reviewed and approved as to form by Annika E. Ashton and Christina A. Blythe from the Office of the County Attorney.
