Why Action is Necessary

Florida Statutes 932.7055(5)(a) requires that proceeds from the disposition of liens and forfeited property obtained from criminal procedure and corrections be deposited in a special law enforcement trust fund to be used for law enforcement purposes.  Recommendation of the Sheriff and Board approval are required to appropriate LETF funds.

 

What Action Accomplishes

A. Provides LETF funding in the amount of $205,527 for the Broward County Money Laundering Task Force.

 

B. Provides LETF funding in the amount of $225,453 for the Organized Crime Task Force.

 

C. Provides LETF funding in the amount of $157,500 for the Narcotics Detection Dog Program.

 

D. Provides LETF funding in the amount of $224,890 for the Broward County Drug Task Force.

 

E. Provides LETF funding in the amount of $491,961 for the Narcotics Interdiction Task Force.

Summary Explanation/Background

A. The Broward Sheriff’s Office supports this LETF request for the operations of the Money Laundering Task Force. The Broward Sheriff’s Office administers the Broward County Money Laundering Task Force (BCMLTF) account for the members of the Task Force. This Agreement has been in place as a result of the MOU which BSO is an active member. along with other cities that participate. The BCMLTF MOU stipulates that twenty percent (20%) of the assets seized is returned to the Task Force to cover operational and administrative costs. The Broward County Money Laundering Task Force works criminal cases which involve money laundering in the South Florida area. The Task Force targets criminal organizations committing illegal acts. and makes arrests and seizes assets associated with their criminal activity.

 

B. The Broward Sheriff’s Office supports this LETF request for the Organized Crime Task Force. The Broward Sheriff’s Office administers the Organized Crime account for the members of the task force. This agreement has been in place as a result of the MOU, which BSO is an active member along with other cities that participate. The Task Force MOU stipulates that twenty percent (20%) of the assets seized is returned to the Task Force to cover operational and administrative costs. The Organized Crime Task Force investigates traditional and non-traditional organized crime groups operating in the South Florida area. Any illegitimate proceeds or assets gained by these organizations through criminal activity will be targeted for seizure by the task force.

 

C. The Broward Sheriff’s Office supports this LETF for the Narcotics Detection Dog Program. The Narcotics Detection Dog Program responsibilities are to assist the Broward Sheriff’s Office Department of Law Enforcement. Department of Detention, local municipalities. state. and Federal agencies that involve narcotics, currency, and firearms investigation within Broward County. This program will continue to assist law enforcement with establishing probable cause and locating evidence that may be concealed, which is necessary for the successful prosecution of an arrest or investigation.

 

D. The Broward Sheriff's Office supports this LETF request for the operations of the Broward County Drug Task Force (BCDTF). The Broward Sheriff's Office administers the Broward County Drug Task Force account for the members of the Task Force. The Agreement has been in place as a result of the MOU, which BSO is an active member, along with the other cities that participate. The Task Force MOU stipulates that twenty percent (20%) of the assets seized is returned to the task force to cover operational and administrative costs The Broward County Drug Task Force works criminal cases and drug trafficking organizations in the South Florida area The Task Force targets criminal organizations committing illegal acts, makes arrests and seizes assets associates with their criminal activity.

 

E. The Broward Sheriff’s Office administers the Narcotics Interdiction Task Force accounts for the members of the Task Force. This agreement has been in place as a result of the MOU. which BSO is an active member. along with the other cities that participate. The Task Force MOU stipulates that twenty percent (20%) of the assets seized is returned to the Task Force to cover operational and administrative costs. Because this is a tenured Task Force there are many seizures. both State and Federal that are pending forfeiture. The Task Force targets criminal organizations committing illegal acts and makes arrests and seizes assets associated with their criminal activity.

 

F. The Broward Sheriff’s Office supports this LETF for the Gang Investigations Task Force (GITF). The Broward Sheriff’s Office administers the Broward County Gang Investigations Task Force account for the members of the Task Force. This agreement has been in place as a result of the MOU. which BSO is an active member. along with the other cities that participate. The Task Force MOU stipulates that thirty percent (30%) of the assets seized is returned to the Task Force to cover operational and administrative costs. The Gang Investigations Task Force conducts investigations into the criminal gang organizations in the South Florida area. The Gang Investigation Task Force makes arrests and seizes assets associated with their criminal activity.

 

G. The Broward Sheriff’s Office supports this LETF request for the Sheriff's Award Program. The initiative is in recognition of the employees that are retiring from the Broward Sheriff's Office with 25 years or more of service. This includes sworn and civilian personnel. The project will also continue to recognize command level employees for their meritorious service More than 100 employees have retired between 2020-2022 since the inception of this program and have received the awards and accolades for their longevity and service to the community and agency.

 

H. The Broward Sheriff's Office supports this LETF request for the Public Safety Illuminated Signage - Cooper City OLE. Currently, the government-owned building that houses the Public Safety Team abuts a main thoroughfare and does not have an illuminated building sign, instead, there are small, hard to see black letter decals. The current decals are not easily visible in this highly congested area, especially at night. The sign will have the BSO emblem which would help increase visibility of the City's Public Safety Team, helping residents better see / know where the building is located. The illuminated sign will also be a crime prevention tool as the building adjoins the City's Sports Complex where historically burglaries /thefts have occurred.

 

I. The Broward Sheriff’s Office supports this LETF request for the Ribbon Bar Project. These award ribbon bars are presented to employees in recognition of our First Responders and additional uniformed personnel.

 

J. The Broward Sheriff's Office supports this LETF request for $320,579 to fund the Broward County Juvenile Firesetter Prevention and Intervention Program. Funding for this program is shared by the Pay Telephone Trust Fund, and the Law Enforcement Trust Fund. Broward County's Juvenile Firesetter Prevention and Intervention programs provide specialized fire safety education for children ages 2-17 and target at-risk children and teens with an interest in or a history of starting fires, initiating bomb threats, creating destructive incendiary devices or pulling fire alarms. By offering fire safety education instruction and community outreach presentations. the program helps reduce incidents of injury, property loss and death. Follow-up surveys and 6-month monitoring process complete the program which has proven highly successful in reducing recidivism.

Fiscal Impact/Cost Summary

Funds are available within the Law Enforcement Trust Fund for these actions.  According to BSO, the current balance of the LETF, as of September 21, 2022, is $4,854,550 in the local account ($3,226,134 of which is unrestricted) and $4,336,800 in the federal account ($2,451,523 of which is unrestricted).  This action will utilize a total of $1,773,266 of the LETF, of which $353,299 is unrestricted local funds, $951,090 is restricted local funds, $181,936 is unrestricted federal funds, and $286,941 is restricted federal funds.
