Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards exceeding $500,000, inclusive of the value of any renewals or extensions provided for in the contract.
Pursuant to Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a commercial service airport over the threshold amount provided in Section 287.017 for CATEGORY FIVE [i.e., $325,000] as a separate line item on the agenda and must provide a reasonable opportunity for public comment; such contracts may not be approved, awarded, or ratified as part of a consent agenda.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development did not establish a County Business Enterprise (CBE) or Disadvantaged Business Enterprise (DBE) goal for this procurement (Exhibit 2).
The purpose of this contract is for the replacement of exterior windows at Terminal 1, Concourses B and C at the Broward County Fort Lauderdale-Hollywood International Airport for the Broward County Aviation Department (BCAD).
The County will fund 83.36% of the project and the Florida Division of Emergency Management, and the Federal Emergency Management Agency (FEMA) through grants, will fund the remaining 16.64%. Accordingly, the solicitation included the applicable FEMA requirements to enable the County to utilize the FEMA grant to fund the specified portion of the cost of this project (Exhibit 2).
BCAD reviewed the bid submitted by the low bidder, Timekey Enterprise LLC, and concurs with the recommendation for award (Exhibit 3). There have been no vendor performance evaluations completed for Timekey Enterprise LLC.
The Purchasing Division researched the prices submitted by the recommended bidder, Timekey Enterprise LLC, and determined that the prices submitted are fair and reasonable in comparison to prices of the cost estimate (Exhibit 4).
This procurement carries a 100% performance and payment guaranty that is due at time of award and is preceded by a bid bond, which was required at time of submittal. The Purchasing Division confirmed with the surety company that Timekey Enterprise LLC has the capacity to obtain the required guaranty.
The bid posted on June 27, 2022 and opened on August 12, 2022; two complete bids were received in addition to one partial bid and zero declinations.
The Recommendation for Award was posted on the Purchasing Division website from September 26 - 30, 2022, at which time any aggrieved vendor could have protested the result. There was no protest or appeal filed regarding this procurement.
