Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

 

What Action Accomplishes

The purpose of the contract is to provide liquid carbon dioxide for Water and Wastewater Services.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) did not assign Small Business Enterprise (SBE) or County Business Enterprise (CBE) goals for this project because there were no subcontracting opportunities for SBE or CBE contractors (Exhibit 2).

 

This contract provides for the purchase and delivery of liquid carbon dioxide for Water and Wastewater Services. Liquid carbon dioxide gas is used in the treatment of drinking water.

 

Water and Wastewater Services has reviewed the bid submitted by Matheson Tri-Gas, Inc., and concurs with the recommendation for award (Exhibit 3). No vendor performance evaluations have been completed for Matheson Tri-Gas, Inc. within the past five years.

 

On July 19, 2022, Bid No. IND2125134B1, Liquid Carbon Dioxide, was advertised; and the bid opening was extended to August 18, 2022. A single bid was received from Matheson Tri-Gas, Inc., with two declinations (Exhibit 1). The two declinations received were from Linde, Inc., citing lack of current supply, and Nexair, citing no product availability. Additionally, when asking the incumbent vendor, Airgas USA, LLC, why it did not submit a bid; it cited that it needed to take several exceptions to the County Standard Terms and Conditions of the bid. The single bid received from Matheson Tri-Gas, Inc. did not take any exceptions to the County Standard Terms and Conditions of the bid.

 

The Purchasing Division researched the prices submitted by the single bidder, Matheson Tri-Gas, Inc., and determined that the prices were fair and reasonable and aligned with current market analysis for the industry (Exhibit 4).

 

Incumbent: Airgas USA, LLC; Contract Number and Title: OPN2119963G1_1, Carbon Dioxide, Liquid, Bulk; Contract Term: December 3, 2019 to January 10, 2023; Expenditures to date: $435,792.37.

 

The bid was advertised on July 19, 2022 and two Addenda were issued to extend through August 18, 2022. Periscope S2G invited 712 vendors to the solicitation, and it was viewed by 24 vendors. The Purchasing Division conducted outreach to all vendors who viewed or downloaded the solicitation, and one bid was received with two declinations (Exhibit 1).

 

As this procurement yielded only a single bid response, a Recommendation for Award was not posted to the Purchasing Division website. There was no protest or appeal filed regarding this procurement.

 

The initial contract period shall begin on January 11, 2023 and terminate one year from that date.
