Summary Explanation/Background

THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

On August 22, 2017 (Item No. 41), the Board of County Commissioners approved the License and Concession Agreement between Broward County and Florida Renaissance Festival, Inc. (RenFest), for Florida Renaissance Festival at Quiet Waters Park, granting a license to RenFest to utilize portions of Quiet Waters Park to hold an annual series of renaissance festivals (each annual series, an “Event”). On January 28, 2020 (Item No. 27), the Board approved the First Amendment to the Agreement, which allowed RenFest to sell liquor and amended other provisions of the Agreement. On September 9, 2021 (Item No. 34), the Board approved a Second Amendment to the Agreement exercising the optional five-year renewal term provided in the Agreement, extending the term through the conclusion of the 2027 Event.

 

The Agreement currently permits RenFest to hold each Event over seven weekends during the year. The proposed Third Amendment would add one weekend each year for a total of eight weekends, beginning with the 2023 Event. The proposed Third Amendment would also authorize the Contract Administrator to approve up to three additional weekends per Event per year starting in 2023, for a maximum of 11 weekends per Event.

 

The proposed Third Amendment includes updates to the County’s standard terms and conditions required by changes to applicable law. In addition, Exhibit A, Section VI(d)(3), of the Agreement has been removed, although RenFest is not restricted in its ability to establish and enforce its own policies to restrict or prohibit the use, display, or bringing of BB guns, firearms, or other weapons within the licensed premises during the Event.

 

This Third Amendment has been reviewed and approved as to legal sufficiency by the Office of the County Attorney.

Fiscal Impact

Fiscal Impact/Cost Summary

This Amendment has no cost to the County since it is a revenue-generating project. Revenue from RenFest Events is deposited into the General Fund. Approval of this Amendment is expected to have a positive fiscal impact of $33,800 in 2023.
