Why Action is Necessary

In accordance with Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Approves the agreement with a qualified Contractor to provide security guard services at the Broward County library locations.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/FACILITIES MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development designated Group 2 as a reserve opportunity to County Business Enterprises (CBE). Centurion Security Group, LLC did not meet the CBE Reserve Program requirements but committed to 40% CBE participation for Group 2 (Exhibit 3).

 

The purpose of this agreement is to engage the services of a pre-qualified firm to provide security guard services at the Broward County library locations.

 

In accordance with the Broward County Living Wage Ordinance, Broward County Code of Ordinances, Section 26-101(i), these services are covered services. The single bidder, Centurion Security Group, LLC, has agreed to be bound to the contractual obligations of the Living Wage Ordinance, as amended, which includes the minimum wage rate of $17.17/hour and employee benefits of health care and paid time off.

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. The single bidder, Centurion Security Group, LLC, has agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

On June 1, 2021 (Item No. 41), the Board approved Request for Qualifications (RFQ) No. GEN2119058R1, General Security Guard Services at Various County Facilities, as Step One of a Two-Step (RFQ/Bid) procurement process.

 

On June 15, 2021, RFQ No. GEN2119058R1, General Security Guard Services Various County Facilities, was advertised. It yielded nine submittals by the submittal deadline of August 4, 2021.

 

On October 1, 2021, a Combination (Initial and Final) Evaluation Committee meeting was held to determine responsiveness and responsibility of proposing firms; hear presentations from responsive and responsible firms; score and rank those firms; AND shortlist up to the three highest scored firms for each of Groups 1 - 3. Three firms were shortlisted for Group 1; one non-CBE firm was shortlisted for Group 2; and two firms (a CBE and a non-CBE) were shortlisted for Group 3.

 

On October 5, 2021, the Step Two Invitations to Bid (ITB) solicitation was advertised to the shortlisted firms for Groups 1 - 3.

 

On October 7, 2021, the proposed recommendation of rankings for Groups 1 - 3 was posted for the three-day period (October 7 - 11, 2021). On October 8, 2021, an objection to the proposed recommendation of ranking for Group 2 was received from the proposing CBE firm for Group 2.

 

On October 19, 2021, an Addendum was issued on the Step Two ITB to remove Group 2 to allow for the underlying objection to be resolved.

 

On October 25, 2021, the Director of Purchasing responded to the objection of proposed ranking for Group 2 defending the exclusion of the proposing CBE firm from advancing to shortlisting and the Step Two bidding process based on the scoring differential requirements of Section 1-81.3(f)(2) of the Business Opportunity Act. The response to the objection reaffirmed the Evaluation Committee’s scores, ranking, and shortlisting for Group 2, resulting in Centurion Security Group, LLC (non-CBE) being the sole shortlisted firm for Group 2.

 

On October 26, 2021, the Step Two ITB for Group 2 was advertised. The solicitation closed with one submittal received from the single shortlisted firm, Centurion Security Group, LLC.

 

On November 4, 2021 (Item No. 63), the Board discussed the status of the Two-Step procurements for Groups 1 - 3 and directed the County Administrator to evaluate the Living Wage Ordinance for potential amendment.

 

On December 7, 2021 (Item No. 84), the Board approved the Rankings of the Step One RFQ GEN2119058R1 (Groups 1 - 3) and directed the County Administrator to analyze the Living Wage Ordinance before proceeding with action on the submittals to the Step Two ITB for Groups 1 - 3.

 

On October 19, 2022, the Director of Purchasing rejected the bids received from Step Two ITB for Groups 1 - 3 based on the need to resolicit with new requirements being proposed as an amendment to the Living Wage Ordinance.

 

On October 25, 2022 (Item No. 49), the Board amended the Living Wage Ordinance.

 

On October 27, 2022, the Step Two ITB was resolicited as GEN2119058B2 Groups 1 - 3, General Security Guard Services for Various County Facilities, as follows: 

 

- GEN2119058B2, Group 1 (Facilities Management Division and Other Agencies),

- GEN2119058B2, Group 2 (Libraries Division), and

- GEN2119058B2, Group 3 (Parks and Recreation Division)

 

On November 7, 2022, submittals were received from the shortlisted firms for the respective three Groups. Groups 1 and 3 will be processed based on Section 21.47(b)(2) of the Procurement Code, which authorizes the Director of Purchasing to award solicitations and execute the associated contracts subject to the conditions specified. Group 2 requires Board award and contract execution as there is only a single bid. 

 

The Facilities Management Division (FMD) has reviewed the bid submitted by Centurion Security Group, LLC, and concurs with the recommendation for award (Exhibit 4). The Purchasing Division and FMD have determined the prices to be fair and reasonable (Exhibit 5).

 

The amounts referenced in this Agenda Item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.

 

This item is being submitted as a supplemental item after the deadline due to the timing of the solicitation given the Board’s determination of the living wage ordinance.
