Why Action is Necessary
A. In accordance with the Broward County Procurement Code, Section 21.25, Sole Source Procurement, Board approval is required for awards exceeding the Director of Purchasing’s authority.
B. In accordance with the Broward County Procurement Code, Section 21.47, Award Authority, Board approval is required for awards exceeding $500,000 that include a single bidder, rejection of apparent low bidder, or protested award.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The purpose of the resultant contract is to provide replacement Vogelsang brand pumps, grinders, repair parts, and commissioning services. Water and Wastewater Services (WWS) has five Vogelsang brand pumps currently installed at the North Regional Wastewater Treatment Plant (NRWWTP). These pumps are used in the Fats, Oils, and Grease (FOG) Receiving Facility. The FOG facility is a dedicated site for the proper disposal of fats, oils, and grease, a common by-product of restaurants, that clog and damage sewer pipes.
In addition to the five pumps, there are three Vogelsang brand grinders on-line at the NRWWTP's thickener building. These grinders are critical to the operations of the NRWWTP as their primary function is to reduce the particle size of solid matter, including rags, wipes, and plastics, which enables further wastewater processing by minimizing problems to equipment and treatment. The grinders protect downstream system components from damage, prevent blockages and clogging of pumps, fittings and pipe streams.
On September 14, 2022, the Purchasing Division issued a Request for Information (RFI) to ascertain whether there were any other entities able to provide Vogelsang brand pumps, grinders, and repair parts. The RFI was advertised for five days per Section 21.25(b) of the Procurement Code. There were no responses to the RFI during this period. Additionally, the manufacturer, Vogelsang, has confirmed that PSI Technologies Inc is the manufacturer’s exclusive municipal distributor for the state of Florida. Based on this information, the Director of Purchasing recommends approval of this sole source, sole brand designation (Exhibit 1).
The County will seek an initial two-year contract in the initial two-year estimated amount of $532,000 with the option to renew for three one-year terms for a potential five-year estimated amount of $1,330,000. The initial contract period shall begin on the date of award and terminate two years from that date.
