Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.56, Board approval is required for change orders on construction contracts that exceed 10% of the original contract amount.

Authorizes the Purchasing Director to approve a change order to the subject contract so that additional work for the surface preparation and gel coating of the four large water park slides at C.B. Smith Park can be completed.

Summary Explanation/Background

THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

A bid for the reapplication of gel coating (“Waterslide Gel Coating”) for the large water slides at Paradise Cove Water Park located at C.B. Smith Park (BLD2122924B1) (the “Contract”) commenced on July 23, 2021, and closed on August 11, 2021. As a result of the bid, Champion Painting Specialty Services (“Champion”) was awarded the contract and a Purchase Order (PRA2101163) was issued in the amount of $194,250, effective September 23, 2021. A Notice to Proceed for the Waterslide Gel Coating project was issued on February 7, 2022. The intent was for this project to be completed by March 11, 2022, to be ready for the seasonal opening of the water park on March 17, 2022.

 

The Waterslide Gel Coating work could not be completed prior to the opening of the water park in March of 2022 because of various supply chain and product availability issues. These issues continued over the next 11 months, resulting in six total delays to the start of the work.

 

On November 28, 2022, the Division received an email request from Champion to approve the provided topcoat color. The color was approved the same day and Champion stated they would secure the materials for the project. Champion subsequently subcontracted the performance of the project to another firm, with a proposed commencement date of January 9, 2023.

 

On January 10, 2023, the County received email correspondence from Champion stating that the existing gel coat on the slides was failing due to a lack of surface preparation during the previous gel coating application. As a result, Champion and its subcontractor would need to completely remove the existing gel coat material in lieu of the specification requirements of only sanding with 60 grit sandpaper.

 

Champion submitted a request to modify the Contract to allow for the required additional surface preparation for a cost of $79,000. Champion’s quote is attached as Exhibit 1. If this change order is approved, it would increase the total project cost by approximately 41%. Pursuant to Section 21.56 of the Broward County Administrative Code, only the Board may approve change orders that, in an individual or cumulative amount, exceed the lesser of 10% of the original contract amount or $100,000.

 

If this item is approved, the Director of Purchasing will be authorized to execute a change order to the Contract in a total amount not to exceed $80,000, which will allow Champion to perform the work required to complete the Waterslide Gel Coating project.

 

The Parks and Recreation Division is requesting approval of this item to ensure this project is completed in time for the start of the 2023 aquatics season, which is intended to avoid any further loss in revenues to the County from slide closures to have work performed during the season.

Funding for this project is budgeted in the Pool Repairs project in the General Capital Outlay Fund. The original cost of the surface preparation and gel coating of the C.B. Smith Park water park slides was estimated at $194,250. The proposed contract increases the cost of this project by up to $80,000 for a new estimated total cost of $274,250. Sufficient budget exists within the Pool Repairs project’s Fiscal Year 2023 Modified Budget to accommodate this increase in the Parks and Recreation Division's General Capital Fund.
