In accordance with the Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Connected Community Goal of “Cooperatively delivering an efficient and accessible regional intermodal transportation network.”

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 30% for this project. Alfred Benesch & Company has committed to 32.55% CBE participation, which was reviewed and approved by OESBD. (Exhibit 2)

 

The purpose of this agreement with Alfred Benesch & Company, a qualified professional consulting firm with transit planning expertise, is to develop a ten-year Transit Development Plan (TDP) for Fiscal Year 2024 - Fiscal Year 2033. Rule 14-73.001, of the Florida Administrative Code (“F.A.C.”), titled “Public Transit,” requires Broward County to create a TDP as its planning, development, and operational guidance document, based on a ten-year horizon and to conduct a major update every five years to receive annual state public transit block grant funding for BCT’s operating and maintenance expenses. The TDP is a strategic business plan and visioning document for the Broward County Transportation Department (“BCT”). The overall goal of the TDP is to address the growth needs of the County’s existing and future transit users as follows: (1) define the public transportation needs in Broward County, (2) evaluate the services BCT currently provides, (3) conduct a robust public participation process, (4) coordinate and seek input from stakeholders and their existing planning efforts, (5) develop agency and community goals and objectives, (6) develop a plan of transit capital and service alternatives that address the community’s transit needs, and (7) develop an action plan that can be monitored and updated by the County on an annual basis. (Exhibit 1)

 

The agreement’s scope defines the tasks that will be completed by the Consultant. These tasks will result in the periodic submission of technical memoranda as work progresses. All tasks culminate in the submission of a draft TDP, and feedback provided will be incorporated into the Final TDP.

 

On November 15, 2022 (Item No. 70), the Board approved Request for Proposals (RFP) No. TRN2125161P1, BCT Transit Development Plan Fiscal Years 2024-2033. Four firms submitted proposals in response to the RFP.

 

On March 6, 2023, the Combination Initial and Final Evaluation Committee meeting was held. During the Evaluation Committee (EC) meeting, the EC passed a motion that determined that all four firms were responsive and responsible to the RFP requirements and would proceed to the final evaluation to be numerically scored and ranked by the EC. After presentations, evaluation, scoring and ranking, the EC named Alfred Benesch & Company as the first-ranked firm.

 

On March 8, 2023, an email was sent to the Board of County Commissioners with the Low Bids Report/RLI/RFP - Committee Member Score Sheets for their review. There were no vendor objections or protests or pulls from the Board for this RFP ranking.

 

The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from March 8-13, 2023, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. There was no additional information submitted within this timeframe.

 

The EC’s final recommendation of ranking was posted on the Purchasing Division website from March 14-20, 2023, which provided an opportunity for any aggrieved proposer to file a formal protest. No formal protest was received.

 

On March 21, 2023, in accordance with the Procurement Code Section 21.42.(k), Procedures for RFPs, RLIs, and RFQs, the ranking of the qualified firms became final, and staff proceeded with negotiations.

 

One negotiation meeting was held to negotiate this Agreement with Alfred Benesch & Company on April 14, 2023. This meeting was attended by representatives from Alfred Benesch & Company, the Transportation Department, the County Attorney’s Office, and the Purchasing Division.
