Board approval is required to release easements, all or in part, pursuant to Section 27.68 of the Broward County Administrative Code and Section 336.09 of Florida Statues.

Directs the County Administrator to publish a Notice of Public Hearing for the release of easement in accordance with Chapter 27, Part XV of the Broward County Administrative Code.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Urban Planning Division has received a request to release a portion of a right-of-way easement granted by the Deed recorded at Official Records Book 4673, Page 953; a 75-foot-wide perpetual right-of-way easement granted by the Deed recorded at Official Records Book 383, Page 453, and a certain right-of-way recorded in Miscellaneous Plat Book 6, Page 23 of the Public Records of Broward County, Florida, generally located on the west side of Davie Road between Service Road and Southwest 37th Street in the Town of Davie. Vacating these easements will provide clear and unencumbered title to the property owner.

 

Review of this application by the applicable reviewing agencies indicates that there is no objection to the release of the subject easements.

 

This vacation application has been reviewed and approved as to form by the Office of the County Attorney (Exhibit 1).
