Summary Explanation/Background

This item approves the Agreement between Broward County (“County”) and City of Fort Lauderdale (“City”) addressing several matters between the parties (the “Agreement”). First, the County is the owner of certain real property located at 1000 Southwest 2nd Street, Fort Lauderdale, Florida 33312 (“Staging Area”), commonly known as the former site of the Broward Addiction Recovery Center (“BARC”). The City of Fort Lauderdale (“City”) has requested to use the Staging Area as a temporary construction staging and parking area while the City redevelops the Fort Lauderdale Police Department. The Agreement provides the City with temporary, non-exclusive use of the Staging Area, subject to the terms contained therein.

 

Second, the County has requested the City transfer certain property located adjacent to the Broward County Main Library (“Main Library”), located at Southeast 1st Street, Fort Lauderdale, Florida 33301 (“Library Property”) for purposes of improvements to the Main Library, including for use as an outdoor meeting, socialization, event space for library patrons and the community at large, and other public uses. The City has agreed to convey the Library to the County via quitclaim deed, in the form attached as Exhibit B of the Agreement, subject to the reservation of a utility easement for the City for existing utilities on the Library Property.

 

Third, the County has identified three properties, all located in the City, as locations for improvement and redevelopment opportunities including: 1000 Southwest 2nd Street for a new affordable housing development, 325 Southwest 28th Street for the expansion of 25 additional beds in the annex area for BARC, and 2000 West Commercial Boulevard for new County governmental facilities. The Agreement provides that the City agrees to support the County and cooperate to the greatest extent permissible with the County obtaining all required licenses, permits, rezoning approval, authorizations, and the like for improvement of the aforementioned properties.

 

On May 16, 2023, the City Council adopted Resolution No. 23-0516, approving the Agreement. Additionally, the City Council adopted Resolution No. 23-0436, declaring the City’s intent to convey the Library Property to the County and setting a public hearing to consider same. The City Council will conduct a public hearing on June 20, 2023, to consider the transfer of the Library Property, pursuant to Section 8.02 of the City’s Charter.
