In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Connected Community Goal of “Cooperatively delivering an efficient and accessible regional intermodal transportation network".

 

The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) participation goal of 30% for this project. Nelson\Nygaard Consulting Associates, Inc. has committed to 30% CBE participation, which was reviewed and approved by OESBD (Exhibit 2).

 

The purpose of this agreement with Nelson\Nygaard Consulting Associates, Inc., a qualified Consultant, is to develop a Comprehensive Operational Analysis (“COA”) and Service Optimization of Broward County’s transit system (BCT). The goal of the COA is to assess the current and future County needs and recommend transit improvements, considering the (1) expansion of fixed route, community shuttle, and commuter express services; (2) integration of the planned premium network; (3) incorporation of Mobility on Demand (“MOD”) options; and (4) recommendations for operational improvements in the near, mid, and long-term that will grow ridership.

 

It is expected that the COA will provide recommendations that include (1) modernizing the route network based on projected demand; (2) evaluations on how to increase annual ridership; (3) updates to BCT's internal service standards and performance criteria for optimal network performance; and (4) identifying operational or systematic inefficiencies and providing solutions (Exhibit 1).

 

On December 13, 2022 (Item No. 25), the Board authorized the County Administrator to approve Request for Proposals (RFP) No. TRN2125190P1, Transit Comprehensive Operational Analysis and Service Optimization during winter recess. On January 10, 2023, the County Administrator approved RFP No. TRN2125190P1. The RFP was advertised on January 23, 2023, and at the time of the submittal deadline on February 22, 2023, three firms submitted proposals in response to the RFP.

 

On April 3, 2023, the Combination Initial and Final Evaluation Committee meeting was held. During the Evaluation Committee (EC) meeting, the EC passed a motion that determined that all three firms were responsive and responsible to the RFP requirements and would proceed to the final evaluation to be numerically scored and ranked by the EC. After presentations, evaluation, scoring and ranking, the EC named Nelson\Nygaard Consulting Associates, Inc. as the first-ranked firm.

 

On April 6, 2023, an email was sent to the Board of County Commissioners with the Low Bids Report/RLI/RFP - Committee Member Score Sheets for their review. There were no vendor objections or protests or pulls from the Board for this RFP ranking.

 

The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from April 5 - 10, 2023, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers. There was no additional information submitted within this timeframe.

 

The EC’s final recommendation of ranking was posted on the Purchasing Division website from April 11 - 17, 2023, which provided an opportunity for any aggrieved proposer to file a formal protest. No formal protest was received.

 

On April 18, 2023, in accordance with Procurement Code Section 21.42.(k) - Procedures for RFPs, RLIs, and RFQs, the ranking of the qualified firms became final, and staff proceeded with negotiations.

 

One negotiation meeting was held to negotiate this Agreement with Nelson\Nygaard Consulting Associates, Inc. on May 3, 2023. This meeting was attended by representatives from Nelson\Nygaard Consulting Associates, Inc., the Transportation Department, the County Attorney’s Office, and the Purchasing Division.
