Why Action is Necessary

In accordance with Broward County Procurement Code Section 21.47(a), the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

 

In accordance with Broward County Procurement Code Section 21.53(a), unless otherwise provided by law, no County contract duration shall exceed five years without the express approval of the Board.

 

In accordance with Broward County Procurement Code Section 21.28, the Purchasing Division may participate in, sponsor, conduct, or administer a cooperative purchasing agreement with one or more governmental agencies or nonprofit entities for the procurement of goods or services where the Director of Purchasing determines that such an agreement conforms to generally accepted standards of public procurement. Purchases made by the County pursuant to such agreements shall be subject to the terms and conditions of the agreement and any applicable rules and regulations of the governmental agency or nonprofit entity that administers the agreement.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT / WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) reviewed the scope of work and did not assign County Business Enterprises (CBE) goals for this procurement (Exhibit 1).

 

On April 1, 2023, the Department of Management Services, an agency of the State of Florida, and Fisher Scientific Company L.L.C. commenced Alternate Contract Source (ACS) No. 41000000-23-OMNIA-ACS for Laboratory Equipment and Supplies (Exhibit 5), utilizing the OMNIA Partners General Lab Supply & Distribution Services, Master Contract No. 2021002889 (“Master Contract”), a national cooperative agreement accessible to public agencies nationally, including state and local governmental entities for the public benefit.

 

The Master Contract was competitively solicited through a Request for Proposal (RFP) No. 002101-July2020 with seven responses received (Exhibit 4). The Master Contract became effective June 15, 2021, and its term currently ends on June 30, 2025. The Master Contract has four years of renewals available. The Secretary of State of Florida evaluated this Master Contract and determined that the use of this Master Contract is cost-effective and to the best value of the State of Florida. This Master Contract provides “hot list” pricing for a list of the most frequently purchased products, as well as discounts off the remainder of the Contractor’s full-line catalog, excluding products that are not specifically designed or intended for laboratory use (Exhibit 6).

 

Broward County Water and Wastewater Services seek to access Alternate Contract Source (ACS) No. 41000000-23-OMNIA-ACS for Laboratory Equipment and Supplies, including, but not limited to, apparatus, biologicals, chemicals, consumables, diagnostics, equipment, furniture, and instruments (Exhibit 2).

 

Approval is requested for an initial two-year term contract in the estimated amount of $2,876,000, with the option to renew for up to two additional two-year periods, for a potential six-year contract value with a potential six-year estimated amount of $8,628,000, to be effective upon date of award through June 30, 2029 (Exhibit 3). The estimated annual usage amount is $1,438,000.

 

A Participating Addendum may be appropriate to address specific County requirements. If the Office of the County Attorney determines that a Participating Addendum is appropriate, this item would authorize the Director of Purchasing to negotiate and execute such a Participating Addendum.
