Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The First Amendment (Exhibit 1) revises and replaces Exhibit D-2, Outcomes for Program 2 in the Agreement, Mobile Crisis Response Team to allow Broward County to better evaluate Henderson Behavioral Health, Inc.’s responsiveness and updates the contact information for the County’s Custodian of Public Records.

 

On September 9, 2021 (Item No. 4), the Commission approved the Agreement between Broward County and Henderson Behavioral Health, Inc., in the amount of $831,176, from October 1, 2021, through September 30, 2022 (Exhibit 2). Contract Adjustment 1 was subsequently executed on August 2, 2022, to reduce funding and the number of unduplicated clients to be served for Program 1 during the initial term (Exhibit 3). The Commission approved the renewal of this Agreement for Option Period 1 on September 8, 2022 (Item No. 3).

 

This item requests Commission approval of the First Amendment that revises and replaces Outcomes for Program 2 Mobile Crisis Response Team (Exhibit D-2 in the Agreement) in its entirety to better evaluate Henderson Behavioral Health, Inc.’s responsiveness and update the contact information for Broward County’s Custodian of Public Records effective from the date of full execution.

 

The Broward County Office of the County Attorney reviewed the First Amendment for legal sufficiency prior to execution of the First Amendment by Henderson Behavioral Health, Inc.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer... shall have or hold any employment or contractual relationship with any business entity... which is... doing business with an agency of which he or she is an officer or employee.” In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Form 4A, Disclosure of Business Transaction, Relationship, or Interest, is attached to this report as Exhibit 4 and constitutes full disclosure of any existing conflict.
