Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE COMMUNITY PARTNERSHIPS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The reallocations will ensure the most effective and efficient use of currently budgeted resources and will allow service providers to increase the number of clients served.

 

On September 8, 2022 (Item No. 3), the Commission approved Resolution No. 2022-393, authorizing appropriation and disbursement of Fiscal Year 2022-2023 funds for agreements with nonprofit organizations and governmental entities to provide various services. The Community Partnerships Division completed its mid-year assessment of how funding is being utilized under all agreements. The mid-year assessment revealed contract utilization patterns and client demands demonstrating a need for increased services in specified service areas, resulting in this recommendation to reallocate underutilized funding. The Community Partnerships Division recommends reallocating underutilized funds to agreements in its Children’s Services Administration Section and Health Care Services Section to meet the current community needs (Exhibit 1). Upon Commission approval, the Human Services Department Director may execute contract adjustments increasing the agreement amounts in accordance with Article 4, Compensation, of the agreements. Commission approval is required because the requested increases in funding amounts exceed the threshold authorized by the terms of the agreements. Retroactive approval is requested to allow service providers to invoice Broward County for services provided to eligible clients starting on the effective date and avoid an interruption in service provision.

 

Two service providers recommended to receive funding reallocations met two of three outcomes for the second quarter of Fiscal Year 2022-2023 (Exhibit 2). Staff is working with these two providers to improve future outcome attainment.

 

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that "no public officer... shall have or hold any employment or contractual relationship with any business entity... which... is... doing business with an agency of which he or she is an officer or employee." In accordance with 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached to this report as Exhibit 3 and constitute full disclosure of any existing conflict.
