Summary Explanation/Background

THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

 

The Enhanced Marine Law Enforcement Grant (EMLEG) program serves to improve boating safety on the waters of Broward County by providing funds to local police agencies and organizations to enhance marine law enforcement and improve boating safety. Pursuant to the Local Option Registration Fees for Vessels established in Chapter 1, Article XXX, of the Broward County Code of Ordinances, County imposes a registration fee on all vessels required to register with the State of Florida that obtain such registration in Broward County. A portion of the monies collected by County from the Local Option Registration Fees for Vessels is expended through the EMLEG Program.

 

In accordance with Chapter 1-526, of the Broward County Code of Ordinances, the Broward County Marine Advisory Committee (MAC) is tasked to solicit and review EMLEG grant applications and make recommendations to the Board for the allocation of EMLEG funds. The MAC’s annual recommendations are included in the County’s budget each Fiscal Year. If the Board approves the grant funding in the annual budget, the County Administrator or their designee enters into an agreement with the grant recipient using the standard form agreement approved by the Board in accordance with Section 33.65 of the Broward County Administrative Code.

 

County is the recipient of Florida Boating Improvement Program (“BBIP”) funds pursuant to Section 328.72, Florida Statutes, for the purpose of constructing, providing, maintaining, or operating recreational channel markers and other uniform waterway markers, public boat ramps, lifts, and hoists, marine railways, boat piers, docks, mooring buoys, and other public launching facilities; and removing derelict vessels, debris that specifically impedes boat access (not including the dredging of channels), and vessels and floating structures deemed a hazard to public safety and health for failure to comply with the requirements under Section 327.53, Florida Statutes.

 

In accordance with Section 33.79 of the Broward County Code Administrative Code, the MAC makes recommendations to the Board to provide BBIP funding to cities or non-profit entities based on submitted grant proposals. These recommendations are incorporated into the County’s annual budget. If the recommendations are approved by the Board, the County Administrator or their designee enters into an agreement with the grant recipient using the form agreement approved by the Board.

 

The Board most recently approved the EMLEG standard form agreement on April 17, 2001 (Item No. 26). The BBIP standard form agreement was most recently approved by the Board on June 20, 2000 (Item No. 32). The new standard form agreements for the EMLEG and the BBIP grant programs (Exhibits 1 and 2, respectively) have been updated to reflect the County’s current standard terms and conditions.

 

The updated standard form agreements have been reviewed and approved as to form by the Office of County Attorney.
