In accordance with the Broward County Procurement Code, amendments to Agreements that exceed the Director of Purchasing’s authority must be approved by the Board.

Approves contract amendment to extend the time for performance and increase the maximum not-to-exceed amount for the ongoing provision of construction management services during construction.

Summary Explanation/Background
THE PUBLIC WORKS DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMENDS APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development has set a County Business Enterprise (CBE) participation goal for this Agreement at 22%. As of January 17, 2024, Hazen and Sawyer, P.C., has received payments totaling $4,073,147, with $994,142 allocated to CBE firms, resulting in a participation rate of 24.4% to-date (Exhibit 1).
On February 10, 2015 (Item No. 26), the Board of County Commissioners approved an Agreement between Broward County and Hazen and Sawyer, P.C., for Consultant Services for Engineering Services for Fine Bubble Aeration Basin Conversion, Request for Proposal No. R1061305P1, (the “Agreement”) for a maximum not-to-exceed amount of $3,901,288, including optional services and reimbursable expenses; with a time for performance of 2,035 days from the date of the Notice to Proceed (Exhibit 2).
On September 22, 2020 (Item No. 03), the Board of County Commissioners approved the First Amendment to the Agreement to extend the time for performance by 730 calendar days for a new total of 2,765 days (Exhibit 3).
On August 5, 2022, the Director of Purchasing approved the Second Amendment to the Agreement to increase the maximum not-to-exceed amount by $294,821 for a new total of $4,196,109 and to extend the time for performance by an additional 540 calendar days for a new total of 3,305 days (Exhibit 4).
If approved, the proposed Third Amendment will increase the maximum not-to-exceed amount by $889,209, including optional services and reimbursable expenses; for a new total of $5,085,318 and will extend the time for performance by an additional 540 calendar days for a new total time for performance of 3,845 days, through August 2025, due to extended construction project delays and the ongoing need for construction management services (Exhibit 5).
