Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the County’s goals of “Healthy Community” and “Resilient Community.” The Centers for Disease Control and Prevention (CDC), Epidemiology and Laboratory Capacity for Prevention and Control of Emerging Infectious Diseases (ELC) Grant, managed by the Florida Department of Agriculture and Consumer Services, provides financial assistance to states and territories in support of mosquito surveillance and control strategies aimed at reducing mosquito populations following significant rainfall events or hurricanes, which subsequently lead to an overabundance of nuisance and disease-carrying mosquito populations and pose a risk of mosquito-borne diseases to Broward County residents.

 

The Grant Agreement (Exhibit 1) provides for Broward County to receive a grant in the amount of $170,000 to procure specific equipment and tools that are utilized for mosquito surveillance and control activities. The budget resolution (Exhibit 2) allows for the appropriation of the grant revenue funds provided by the Florida Department of Agriculture and Consumer Services (FDACS). The Grant Agreement does not require County to match the grant funds.

 

The Grant Agreement will commence upon execution and end on July 31, 2024, and allows the County to procure mosquito traps and larvicide and adulticide equipment. The Grant Agreement is on a state-provided form utilized by FDACS and includes clauses that deviate from the County’s standard terms and conditions, including, but not limited to: (a) intellectual property ownership right claimed by FDACS for anything that is produced by or developed in connection with this agreement, (b) a records retention requirement for a period of five years, (c) mutual termination for convenience with at least 30 days advance written notice, and (d) requirement, to the extent permitted by law, that the County hold harmless, defend, and indemnify FDACS from any and all claims, suits, charges and judgments whatsoever that arise out of the County’s performance or nonperformance of the services or subject matter called for in the agreement.

 

The Grant Agreement has been approved as to form by the Office of the County Attorney.
