Summary Explanation/Background
THE COUNTY ADMINISTRATOR RECOMMENDS APPROVAL.

On December 8, 2023, the County received an Unsolicited Public Private Partnership Proposal from Hypower, LLC ("Hypower") and Moffatt & Nichol ("M&N") to Design, Build, and Finance Shore Power Infrastructure Development for Port Everglades. The original proposal was received from Hypower and M&N on December 8, 2023, along with the $25,000 application fee required by Section 38.40 of the Broward County Administrative Code. On January 4, 2024, Hypower was advised that a Cone of Silence was imposed as provided for in Section 1-266 of the Broward County Code of Ordinances, retroactive to the date of receipt of the original proposal. Additional information covering Financial and Functional Feasibility was received from Hypower on January 22, 2024. By memo dated February 13, 2024, the County Administrator advised the Board that County staff would examine the information presented, perform a preliminary financial analysis, and make a recommendation on how to proceed pursuant to Florida Statutes Section 255.065 within 45 ...
