Why Action is Necessary
Motion A: In accordance with the Broward County Procurement Code, Section 21.56, Board approval is required for change orders of $250,000 or more.
Motion B: In accordance with the Broward County Procurement Code, Section 21.56, Board approval is required for a change order allowance increase exceeding 10% of the original contract amount.
What Action Accomplishes
Motion A: Extends the contract duration by 180 days and provides funding for additional work for Everglades Holiday Park Site Improvements.
Motion B: Increases the change order allowance for Everglades Holiday Park Site Improvements for any potential change orders for the remainder of the construction contract.

Summary Explanation/Background
THE PARKS AND RECREATION DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.
The Office of Economic and Small Business Development (“OESBD”) established a County Business Enterprise (“CBE”) goal of 25% for this Contract. MBR Construction, Inc. (“MBR”) committed to 34.4% CBE participation. To date, MBR has been paid $4,512,267 and has paid CBE firms $1,272,625, for 28.2% participation (Exhibit 2).
On January 2, 2020, the Director of Purchasing, based on delegated authority as a result of a clean low bid, executed the Contract between Broward County (“County”) and MBR, for the Everglades Holiday Park Site Improvements (the “Project”) in the amount of $10,584,210, to be substantially completed within 425 calendar days from the Project Initiation Date listed in the Second Notice to Proceed.
Four change orders have been processed to date for a total change order amount of $506,599 and a total amended contract amount of $11,090,809.
The Project provides for a major renovation of the park site with construction of new boat ramps, a levee wall, docks, parking, improved vehicular and pedestrian circulation, utilities infrastructure, minor buildings, site lighting, fire protection, landscaping, and irrigation.
Motion A
Approval of Change Order No. 5 (Exhibit 1) will extend the contract duration by 180 days and increase the contract amount by $588,850 for a revised total contract amount of $11,679,659. The Project design has been updated to include enhancements to the site areas adjacent to the main concession/operations building. These enhancements, which include an outdoor entrance plaza, decorative concrete sidewalks to replace an existing asphalt levee road, decorative railings, added landscaping, and site furnishings, will greatly improve the visitor experience and complement the public art feature that has been commissioned. This action also increases the change order allowance for the Project by 5.56% for a total 10.35% allowance.
Motion B
Approval of this action increases the change order allowance from 10.35% to 14.13% to allow the Parks and Recreation Division to address any unforeseen circumstances as the Project progresses to completion.
These actions have been reviewed and approved as to form by the Office of the County Attorney.
