Why Action is Necessary

In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

 

In accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a commercial service airport over the threshold amount provided in § 287.017 for CATEGORY FIVE [i.e., $325,000] as a separate line item on the agenda and must provide a reasonable opportunity for public comment. Such contracts may not be approved, awarded, or ratified as part of a consent agenda.

Provides for an open-end contract for all maintenance, repair, and operations services for the baggage handling systems located in Terminals 1 through 4 of the Broward County Fort Lauderdale-Hollywood International Airport and the outbound cruise Terminal 25 located at Port Everglades.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) did not assign County Business Enterprise participation goals to this project. The OESBD determined that this project is subject to the Broward County Workforce Investment Program (Exhibit 2).

 

The purpose of this contract is to provide all maintenance, repair, and operations services for the baggage handling systems located in Terminals 1 through 4 of the Broward County Fort Lauderdale-Hollywood International Airport as well as the outbound baggage handling systems maintenance and repair services in Cruise Terminal 25 located at Port Everglades.

 

In accordance with the Broward County Workforce Investment Program, Broward County Administrative Code, Section 19.211, these services are subject to the Workforce Investment Program. ERMC Aviation LLC has agreed to be bound to the contractual obligations of the Workforce Investment Program.

 

In accordance with the Broward County Living Wage Ordinance, Broward County Administrative Code, Section 26-101(i), these services are covered services. ERMC Aviation LLC has agreed to be bound to the contractual obligations of the Living Wage Ordinance.

 

The allowances in this contract in the annual amount of $643,000, includes: $628,000 for miscellaneous parts, materials, and inspections, and $15,000 for permits and fees. Expenditures under these allowances must be approved by the Contract Administrator and will be reimbursed at the contractor's actual incurred cost without mark-up.

 

The Aviation Department reviewed the bid submitted by ERMC Aviation, LLC and concurs with the recommendation for award (Exhibit 3). One final vendor performance evaluation has been completed for ERMC Aviation, LLC; the firm has an overall rating of 3.91 out of a possible rating of 5.0.

 

The prices submitted by the recommended bidder, ERMC Aviation, LLC, have been determined to be fair and reasonable by the Aviation Department (Exhibit 4).

 

Incumbent: ERMC Aviation, LLC; Contract Number and Title: OPN2118883B1, Baggage Handling Systems, Maintenance, Repair and Operations Services (services at Terminal 2 at Fort Lauderdale-Hollywood International Airport and Terminal 25 at Port Everglades). Contract Term: September 1, 2020 through October 31, 2022. Expenditures to date: $1,721,574.

 

The bid posted on January 31, 2022 and opened on March 16, 2022; five bids were received with no declinations (Exhibit 1).

 

The Recommendation for Award was posted on the Purchasing Division website from May 2 - 6, 2022. There was no protest filed regarding this procurement.

 

The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual annual amount of the award.

 

The initial contract period shall begin on July 1, 2022 and shall terminate three years from that date.
